Guwahati: Shyamkanu Mahanta, one of the accused in the Zubeen Garg death case, filed a criminal writ petition with the Supreme Court last Tuesday, seeking the transfer of the investigation from the SIT to the CBI or the NIA and appointing a retired Supreme Court judge to oversee the probe. The petition was submitted a day before Mahanta's arrest by the Assam Police Special Investigation Team (SIT) at Delhi airport.In his petition, Mahanta also requested protection for himself and his family from the central govt and the NIA, citing public outrage. He expressed a desire to participate in the investigation at the NIA or CBI office in New Delhi.Mahanta, who is the brother of former Assam DGP Bhaskar Jyoti Mahanta, also sought a directive from the Supreme Court to prevent his detention or any coercive action against him. Additionally, he requested the suspension of the look-out circular issued by the SIT.However, these prayers have become infructuous as he was already caught by the Bureau of Immigration at the Indira Gandhi International Airport in New Delhi in the wee hours of Wednesday and later arrested by the SIT. He is currently in 14-day custody with nine-member SIT from Wednesday.The accused remained absconding till last Wednesday since Zubeen's death while swimming in the sea in Singapore on Sept 19. The singer had gone to Singapore on Sept 17 and was scheduled to perform in the festival on Sept 20 evening.Mahanta also prayed before the SC, seeking a direction to the authorities to de-seal his residential premises and defreeze his bank accounts.Among the grounds of the petition, Mahanta said he is a "victim of a well calculated witch-hunt", alleging false narrative against him in the media. He stated that the allegations against him are ludicrous as he,who was the event organizer of the North East India festival in Singapore during Sept 19-21, was not even present at the scene of the demise of the singer.He further alleged that there are statements by the top executive members of the state of Assam "vilifying him ostensibly on the ground of the petitioner taking the deceased to a foreign country for musical performance and the singer's death in the foreign country."All Assam Lawyers' Association's decision not to represent the accused persons in the Zubeen death case and life threats Mahanta had allegedly received through e-mails, messages and social media platforms are the other grounds mentioned by Mahanta why he filed the petition before the SC.The petitioner stated that the authorities concerned in Singapore are conducting the necessary investigation into the death as the occurrence of the incident is there and "even during the course of that investigation, the petitioner was neither treated as an accused or suspect or even as a witness."Stating that since, as per media report, no element of foul play was discovered or alleged by the Singapore authorities, he stated that "there exists no legal or factual foundation to drag the petitioner into criminal proceedings in India."Even though Mahanta filed the criminal writ petition through advocate Raj Kamal on Sept 30, the case is yet to be listed by the apex court.Besides Mahanta, Zubeen's manager Siddharth Sharma, drummer Shekhar Jyoti Goswami and co-singer Amritprabha Mahanta have been arrested under the charges of criminal conspiracy, culpable homicide not amounting to murder and causing death by negligence initially. However, the SIT on Thursday added the charge of murder under the Bharatiya Nyaya Sanhita, 2023 in the case based on interrogation so far.
