'C-section delivery a month before actual due date': Court summons gynaecologist | Delhi News - The Times of India

New Delhi: A Delhi court, while observing on Wednesday that a pregnant woman was unnecessarily subjected to a C-section delivery a month before the due date, summoned her gynaecologist for the first time. The child, born in Feb 2018, died in Dec 2023 after prolonged illness. The child's father filed a case in 2021 citing medical negligence by the private hospital and four doctors, including the gynaecologist. In Aug 2019, Delhi Medical Council removed the doctor's name from the state medical register for 90 days after the child's father raised the matter at various forums. The doctor filed an appeal before Medical Council of India, seeking revocation of the directions. In June 2020, the ethics committee of MCI found no prima facie case of negligence against the doctor. However, the patient's husband moved Delhi High Court, which stayed MCI's order till further orders. The petition is still before the court. On Wednesday, additional chief judicial magistrate Amardeep Kaur said the child had suffered from his birth continuously but also ruled out that a case of medical negligence could be made. The court said the surgery had led to a scar rupture, which resulted in the baby being born severely asphyxiated. The child lived in a vegetative state and then eventually died. "The doctor, after committing an error in the calculation of the estimated date of delivery, negligently conducted an unnecessary medical procedure on the patient based on a wrong premise that she had completed/exceeded her term of pregnancy," the judge said on Oct 15. The Delhi-based gynaecologist has been charged under IPC sections 336 (endangering life or personal safety of others), 338 (causing grievous hurt to any person), and 201 (causing disappearance of evidence of offence or giving false information to screen offender). The court was hearing a protest petition filed by the child's father against the final report of an investigation officer, which gave a clean chit to the doctor. The court said the gynaecologist manipulated the dates in the discharge summary to "screen herself from punishment, knowing that the information being mentioned by her in the discharge statement is untrue". The judge said the patient and her baby were healthy and suffered no complications throughout the entire pregnancy but were subjected to risks unnecessarily due to the doctor's error. "The doctor, being ignorant of the error in calculating the estimated date of delivery, administered oxytocin to her in order to induce labour," the court said. However, there was nothing to indicate that the continuous illnesses the child faced from birth were the actual cause of his death. Hence, the offence under IPC section 304A (causing death by negligence) could not be made out, the court said. There could be multiple intervening factors, including lack of care, administration of a wrong medicine, administration of some wrong procedure, etc., which could have been the immediate cause of his death. "It is unfortunate, one young life had to suffer extreme medical exigencies through his entire lifetime, but in the absence of any evidence and relation to the direct cause of death, negligence cannot be attributed to the medical practitioner who conducted his delivery, years ago," the court said.
