New Delhi: An underaged teenage survivor of rape seeking to immediately end her unwanted pregnancy of 27 weeks will have to wait until the fetus reaches the gestational period of 34 weeks so that the child can be born, Delhi High Court ordered on Thursday."Don't ask us to be a part of foeticide. Every endeavour must be made by the state to protect life," the bench of Chief Justice DK Upadhyaya and Justice Anish Dayal told the counsel for the survivor, after AIIMS highlighted that aborting the 16-year-old girl's pregnancy at 27 weeks may harm her reproductive health permanently and amount to foeticide as the baby will be born alive.It would be in the best interest of the child to be born as well as for the mother if the pregnancy continued for another 4-6 weeks as it would mean a child would be less dependent on intensive medical care, the AIIMS experts said.With the survivor agreeing to continue with her pregnancy, the court paused its earlier order, which was challenged by AIIMS in its appeal.It noted that "the facts and circumstances of this case present a very unfortunate, unpleasant and precarious situation where this court has to ensure the welfare of both the minor girl as well as the child to be born."During the morning session, additional solicitor-general Aishwarya Bhati and advocate Tushar Gupta, representing AIIMS, said that the medical board had opined that the girl's health needed to be protected. In response to the court's query on whether it would be safe for a child to be born after 34 weeks, Bhati said yes. The bench decided to hear the AIIMS panel doctors as well as the counsel for the girl and her mother.In the afternoon, the medical experts submitted that if the procedure was performed right now, it would be a pre-term delivery. The child would be alive and require medical intervention. There would be a possibility of severe neurological or other problems for the child too.The doctors said that it would amount to foeticide, only permissible in medical issues. It would also hamper the survivor's reproductive health.The court then told advocate Anwesh Madhukar, representing the victim and her mother, that "it will be a foeticide which is only permissible in cases with medical issues. It amounts to an offence under the criminal law, and please don't ask us to be party to that." It asked the lawyer to make her clients understand that it would be in the interest of the survivor and her child to continue with the pregnancy. After delivery, if she wished, the infant could be given up for adoption.After a brief gap, Madhukar told the bench that the survivor had agreed to continue with the pregnancy. The girl should remain admitted to AIIMS for the entire gestation period and until her delivery. She should be allowed to stay in AIIMS until she felt fit after delivering the child, it added.The court directed AIIMS to provide free treatment to the girl and the child for five years and asked Delhi govt to file an affidavit giving details on helping them.
