New Delhi: A Delhi court has acquitted 16 people accused of rioting, arson and unlawful assembly in a 2012 Old Delhi case for the lack of evidence against them."Things appear not to have happened in the manner these have been projected," the court said. None of the several prosecution witnesses had identified any accused person, nor had they explained their roles, raising "serious doubts" about the prosecution's story, additional sessions judge Virender Kumar Kharta said, while acquitting the accused on Sept 24.The prosecution had alleged that the accused had assembled unlawfully, thrown stones, torched a police post, committed rioting and arson, used criminal force against public servants, damaged properties and committed theft in the Urdu Bazar area near Jama Masjid on the intervening night of July 21-22, 2012.Underlining that the prosecution failed to "prove the ingredients of the offences", the judge pointed out that the investigating officer failed to collect CCTV footage of the spot or the area from where the mob would have passed. No incriminating material was seized from the accused, nor could the incident of theft from a car be attributed to them. There were no independent witnesses to prove the allegations and there were inconsistencies and contradictions in the testimonies of the complainant, head constable Raj Kumar, and others, which were not corroborated by material evidence, the court said.
