Supreme Court's partial stay on Waqf (Amendment) Act a major step towards undoing BJP government's 'unconstitutional' amendments: Stalin

Tamil Nadu Chief Minister and DMK president M.K. Stalin, on Monday (September 15, 2025), welcomed the Supreme Court's partial stay on some of the key provisions of the Waqf (Amendment) Act 2025 brought about by the BJP-led union government. Mr. Stalin termed the order as a major step towards "undoing the unconstitutional and illegal amendments." The DMK has consistently opposed these amendments from the time the Bill was introduced in the Parliament, he said. "After it became an Act, the DMK challenged it in the Supreme Court and succeeded, alongside others. The DMK government also passed an Assembly resolution urging the Union government to withdraw the #WaqfAmendment Bill, countering the BJP's attempt to misuse governmental power," the Chief Minister wrote in his social media post. T.N. CM Stalin writes to PM Modi urging complete withdrawal of Waqf (Amendment) Bill Mr. Stalin further said the apex court's order "strengthened the hope and trust that people place in the Supreme Court to safeguard the religious rights of the Muslim minority community and to uphold the Constitution." He said the partial stay on key provisions of the BJP government's amendments -- the mandatory five-year practice requirement before dedicating a Waqf, the power to divest Waqf properties on mere allegation of being government property pending report of a designated officer or decision of the government. TVK chief Vijay moves Supreme Court against Waqf Act He said the stay on some provisions, including the Collector's power to denotify 'Waqf by user' (property treated as Waqf after long period of religious use) and inclusion of more than four non-Muslim members in the Central Waqf Board and more than three in the State Waqf Boards, would ensure Muslim majority in these Boards.
