New Delhi: The Supreme Court on Thursday directed the Election Commission of India (ECI) to provide detailed information regarding the Special Intensive Revision (SIR) of electoral rolls in Bihar, amid ongoing legal challenges and political controversy surrounding the exercise. A bench comprising Justices Surya Kant and Joymalya Bagchi resumed hearing pleas challenging the June 24 decision by the ECI to conduct the SIR in the state, and sought clarity on the documents considered during the 2003 intensive electoral roll revision. The court has asked the ECI to disclose the identities of around 65 lakh voters who were deleted from the rolls, including those who have died, migrated, or shifted constituencies. It also directed the ECI to submit a compliance report by August 22. The top court asked why these names cannot be displayed publicly, either on notice boards or official websites, so that aggrieved citizens can take remedial measures within 30 days. The bench emphasised that citizens' electoral rights should not depend on the discretion of political party workers. During the hearing, advocate Nizam Pasha, appearing for one of the petitioners, challenged the reference to January 1, 2003, in the ECI's orders, stating that "if the date of January 1, 2003, goes, then everything goes." He argued that there was no legal justification for considering this date, and that EPIC (voter) cards issued during summary revisions should not be disregarded in favour of those from earlier intensive exercises. "No receipt or acknowledgement is given when forms are submitted, giving excessive discretion to booth-level officers," Pasha submitted. Senior advocate Shoeb Alam, representing another petitioner, questioned the adequacy of reasoning in the ECI notification. "The process created is neither summary nor intensive -- it is a new invention by the notification. This is a process of voter registration, not disqualification. It should welcome citizens, not turn them away," he said. The ECI informed the court that approximately 6.5 crore voters in Bihar are not required to submit any documents under the current SIR. It added that the process is unfolding in an environment of sharp political hostility, with nearly every decision being contested by various parties. The bench also asked the ECI to publish details of deleted voters at the office of the district returning officer and consider issuing a public notice specifying the website or location where this information can be accessed. The Commission has agreed to share lists of voters who have died, migrated, or shifted at the district level. The Supreme Court had earlier noted that electoral rolls cannot remain static and that periodic revisions are essential to ensure voter accuracy. The expanded list of acceptable identity documents -- from seven to 11 -- under the Bihar SIR was described by the court as "voter-friendly and not exclusionary." Opposition parties, including the Rashtriya Janata Dal (RJD) and Congress, as well as the NGO Association of Democratic Reforms (ADR), have challenged the exercise, alleging irregularities and potential political manipulation in poll-bound Bihar. The bench, however, clarified that the ECI retains residual powers to conduct revisions as it deems fit and that the exercise, if carried out in accordance with the law, cannot be struck down outright.
