New Delhi: The Delhi High Court on Wednesday sought responses from the state government and the Commission for Air Quality Management (CAQM) in the National Capital Region on a petition challenging fines and prosecution against fuel retailers for violating restrictions imposed on refuelling more than 10-year-old diesel and more than 15-year-old petrol cars. From Tuesday, petrol pumps in the NCR stopped refuelling these so-called end-of-life vehicles, following a notice from CAQM. Vehicular pollution is cited as one of the key contributors to pollution in NCR, among the world's most polluted urban centres. The Delhi Petrol Dealers Association told the court that penalty orders by the state government had burdened petrol pump owners with the responsibility of implementing the ban without them being necessarily equipped or authorised under any law to carry out such responsibility. Aggrieved by penalty and prosecution proceedings under Section 192 of the Motor Vehicles Act, 1988 against petrol pump owners, which otherwise are not applicable to them, counsel Adyasha Nanda and Apoorva Pandey said petrol dealers are also being penalised for any non-compliance which may happen due to "sheer inadvertence". "The impugned orders are also manifestly arbitrary, irrational, unreasonable, and disproportionate for the reason that they seek to penalise petrol pump owners for acts which may arise from sheer inadvertence and at times, for reasons beyond control of the petrol pump owners and their attendants," the association stated.
