New Delhi: The Supreme Court on Thursday observed that a misunderstanding exists in the concept of mediation in matrimonial cases as it has often been thought mediation means that parties have to be together. The oral observation was made by a bench comprising Justices KV Viswanathan and N Kotiswar Singh, while hearing a transfer petition in connection with a matrimonial dispute. Justice Viswanathan said in matrimonial matters, the bench finds that there is a misunderstanding on the concept of mediation. He said the moment the court says mediation, the parties' feels that the court is directing them to be together. He stressed that the court only wants a solution and it does not mean insisting on parties to be together.
