New Delhi: The Centre, while defending its stand in the ongoing hearing in the Sabarimala Case, told the Supreme Court that Hinduism not only treats women as equals but also places them on a pedestal much higher than men. Solicitor General Tushar Mehta was presenting the Centre's case before the apex court. The nine-judge Constitution bench is hearing the petition related discriminated against women at religious places, including the famous Sabarimala temple. The Solicitor General cited various examples where men are not allowed in several temples across the country as part of longstanding religious customs. He gave examples of six temples: Brahma Temple in Pushkar, Bhagavati Amman Temple in Kanyakumari, Attukal Bhagavathy Temple in Kerala, Chakkulathukavu Temple in Kerala, Mata Temple in Bihar, Kottankulangara Sree Devi Temple in Kerala and Kamrup Kamakhya Temple in Assam. He argued the permissibility of entry based on gender doesn't come under 'gender discrimination' but a part of religious practice, faith and belief which is beyond the scope of judicial review. He mentioned about Pushkar's Braham temple where married men are not allowed and the Kerala temple where men have to cross-dress to seek the goddess's blessings. 2018 judgement questioned Mehta, in his argument, said that the court lifted the temple ban on entry in the 2018 judgment, but that was based on the assumption that men are superior to women. He said that this does not reflect the practices that are exercised in the name of Hindu traditions. He added, "It is submitted that considering its unique and distinct features in Hinduism, its rituals, beliefs, mode of worship and other religious rights under Article 25 and 26 can never be tested directly, without any balancing and optimisation, on the touchstone of Article 14." He adds that "it is Hinduism which has always had the concept of worshipping 'womanhood', even during prehistoric times. Hinduism has not just treated women as equals, but women are placed on a much higher pedestal than men.
