Bengaluru, Apr 9 (UNI) The Karnataka High Court on Thursday dismissed a public interest litigation challenging a Central government advisory that recommended schools to sing all six stanzas of the national song Vande Mataram, observing that the directive was not mandatory. A Bench comprising Chief Justice Vibhu Bakhru and Justice CM Poonacha declined to entertain the plea, noting that the union Ministry of Home Affairs advisory used the word "may," indicating that institutions were not obligated to follow it. The Court emphasised that there was no statutory mandate governing the rendition of the national song. The Bench also underlined the distinction between the national anthem and the national song, stating that while the anthem is governed by established legal and regulatory provisions, the national song does not fall under any statutory framework. It further took note of submissions by Additional Solicitor General Aravind Kamath, who informed the Court that a similar petition had already been dismissed by the Supreme Court of India. The PIL, filed by advocate Somashekhar Rajavamshi, had challenged the Centre's February 2026 protocol advisory, arguing that it effectively compelled students in State-funded schools to participate in singing all six stanzas of Vande Mataram, including portions that reference Hindu deities. The petitioner contended that while the initial stanzas of the song were widely accepted as patriotic, the extended version includes references to goddesses Durga, Lakshmi and Saraswati, and mandating its daily rendition in schools amounted to a violation of constitutional guarantees of secularism, equality, and freedom of conscience. He had further argued that such a directive through an executive advisory could not impose religious elements on students in State-funded institutions, citing potential violations of Articles 14 and 25 to 28 of the Constitution. However, the High Court, after considering the submissions, stated that it was not inclined to examine the matter in detail since the advisory itself was not binding in nature. The Bench observed that it would not be appropriate to expend judicial time on a non-mandatory instruction and accordingly dismissed the petition.
