Rajkot: A court in Bhuj convicted retired Indian Police Service officer Kuldeep Sharma and former police inspector Girish Vasavda of wrongful confinement (IPC Section 342) of Congress leader Abdul Haji Ibrahim alias Ibhla Sheth (now deceased) in his office in 1984 and sentenced them to three months' simple imprisonment and a fine of Rs 1,000 each. Principal senior civil judge B M Prajapati acquitted them of charges of voluntarily causing hurt (IPC 323), intentional insult (IPC 504) and criminal intimidation (506 (2)) by granting them the benefit of the doubt in the 41-year-old case. A complaint was filed in a Bhuj court by one Shankar Joshi seeking action against Sharma, Vasavada and two other accused (now deceased) under Sections 342 (wrongful confinement), 323 (voluntarily causing hurt) and 506 (criminal intimidation) of the IPC. The court noted that the prosecution failed to prove beyond a doubt that the accused beat the victim with a stick and caused injury voluntarily. However, they succeeded in proving the confinement of the victim in connivance with each other. "The court held Sharma and Vasavada guilty under Section 342 of the IPC and sentenced them to three months' jail and Rs 1,000 fine each," Joshi's lawyer R S Gadhvi said. The case was registered in May 1984 after a complaint was filed by Shankar Joshi in May 1984. According to the complaint, they went to make a representation on the harassment of a person arrested by Naliya police station to the then Mandvi MLA Jaykumar Sanghvi. The next day, the complainant, along with Haji Abdulla Haji Ibrahim alias Ibhla Sheth and a few other persons, went to the SP office to represent the same issue. According to the accusation, Sharma asked for everybody's name in the delegation and lost his temper upon hearing the name of Haji Abdulla Haji Ibrahim alias Ibhla Sheth. He asked everybody to leave and thereafter allegedly beat Sheth with a stick. After the complaint was filed in the Bhuj court, a process was issued against Sharma who approached the Gujarat high court to quash the legal action. The HC turned down Sharma's application, after which he applied for regular bail in Bhuj court on the grounds that the govt had not sanctioned his prosecution which is necessary as he was a public servant, Gadhvi said. After the Bhuj court rejected Sharma's bail plea, he approached the high court and sought permission to file a fresh bail application in the lower court, which was allowed. Meanwhile, the complainant approached the state govt, which granted sanction to prosecute Sharma and Vasavada in Feb 2012, nearly 28 years after the complaint was lodged against them. Sharma challenged the sanction for prosecution in the sessions court and the HC. He approached the Supreme Court after the high court turned down his plea. The apex court directed the Bhuj court to complete the case proceedings within three months, Gadhvi said. Sharma and his brother, suspended IAS officer Pradeep Sharma, were in the crosshairs of the then state govt. Kuldeep Sharma, who joined IPS in 1976, had played a prominent role as head of the state CID in the Sohrabuddin Sheikh alleged fake encounter case. A separate case for an alleged fake encounter was registered against Sharma on an application filed by a Kutch resident, Jusab Juma Mokha, who alleged five members of his family were killed by police in 1984 when Sharma was the superintendent of police in Kutch district. The high court in Aug 2010 quashed the FIR against Sharma in the encounter case. In Sep 2015, nearly a year after his retirement, Sharma joined the Congress party.
