Dharwad, Oct 28 (UNI) The Dharwad Bench of Karnataka High Court today stayed a Home Department order issued on October 18 that prohibited gatherings of more than ten persons for peaceful civic, social or cultural activities in public places and treated such assemblies as unlawful. Justice M Nagaprasanna passed the interim order while hearing a petition filed by Punashchetana Seva Samaste, which challenged the constitutional validity of the directive. The government circular, which has drawn criticism from several organisations, is being widely viewed as an attempt to restrict RSS activities and morning shakhas in public parks and open spaces across the state. Senior Advocate Ashok Haranhalli, appearing for the petitioners, submitted that the order struck at the core of Article 19(1)(b) of the Constitution. "In exercise of executive power, can the rights conferred by Article 19(1)(b) be taken away? Suppose I am doing a laughter club in a park, or a walking group -- how does it become an unlawful assembly?" he argued, adding that ordinary gatherings are being turned into offences without legislative backing. He also pointed out that parks and streets vest with local bodies under municipal and parks laws, not the state's Home Department. When the bench sought clarity on who issued the directive, Haranhalli confirmed it was promulgated by the Home Department. "The government cannot say that this is an offence and register a case," he submitted. The state sought a day's time to file its objections, which the court granted. The government order stated that any procession, rally or public activity involving the use of government properties, including roads, parks, playgrounds, water bodies, or other immovable property under municipal corporations or state-maintained boards, would be considered an unlawful assembly if more than ten persons participate, inviting penal provisions under the Bharatiya Nyaya Sanhita, 2023. Holding that the order prima facie infringes on fundamental rights, the court observed that the restrictions effectively take away freedoms guaranteed under Article 19(1)(a) and 19(1)(b). "It is trite law that a right conferred under Chapter III of the Constitution of India can be taken away only by a law promulgated, not by a government order," the bench noted. It further stated that allowing the order to remain would violate Article 13(2), which prohibits the state from abridging fundamental rights without statutory backing. Granting interim relief, the court directed that the order and all consequential action arising from it shall remain stayed until the next hearing on Monday, November 17.
