New Delhi: Delhi High Court has acquitted a man sentenced to 10 years in prison for raping a minor, ruling that a mere claim of "physical relations" without supporting evidence is insufficient to establish rape or aggravated penetrative sexual assault. The case involved a 16-year-old girl who accused the man -- her cousin -- of establishing "physical relations" with her for over a year in 2014 under the false promise of marriage. Justice Manoj Kumar Ohri, in a recent order, said that while the girl and her parents repeatedly mentioned "physical relations", they did not clarify what the term specifically referred to. "No detailed description of the alleged act was provided, and neither the prosecution nor the trial court asked the girl any questions to clarify whether the essential elements of the offence were established," he said. "The conviction under Section 376 of the IPC and Section 6 of the Pocso Act cannot be sustained on such grounds," he added. The man had challenged his conviction, and the high court had allowed his appeal, highlighting that the prosecution's case was based solely on oral testimonies from the girl and her parents, with no forensic evidence presented. The court further pointed out that "physical relations" is neither defined in the IPC nor in the Pocso Act, and there was no explanation regarding whether the girl's use of the term met the criteria for penetrative sexual assault. "If it appears that the testimony of the girl lacks crucial details, it is the duty of the court to ask appropriate questions to clarify the facts, verify her ability to give testimony and ensure that a full and complete testimony is recorded," the HC noted.
