Hyderabad: The Supreme Court on Thursday dismissed the state govt's special leave petition (SLP) challenging the high court directive that stayed its order (GO 9) to enhance BC reservations to 42% in local body elections.The division bench of Justices Vikram Nath and Sandeep Mehta, while declining to interfere with the HC's interim order, clarified that the state election commission can proceed with the polls on the basis of the existing reservations (prior to the issuance of the GO). The bench also noted that the HC should take a decision on the main matter on its merits without being influenced by their observations.On Oct 9, the Telangana HC issued an interim stay on the state govt's order to increase BC reservations and directed the state to file a counter. It also gave two weeks thereafter for the petitioners to file their responses. Following the order, the state election commission put on hold the election process for local bodies.The state subsequently filed an SLP challenging the HC's interim order on Oct 14.During the hearing, the bench asked the state why it could not have gone ahead with increasing reservations before issuing the notification. "If they (state) are increasing reservations here (to BCs), they have to reduce for other categories," observed the bench.Appearing for the state govt, senior counsel Abhishek Manu Singhvi responded that they had been waiting for the governor's consent and emphasised that the decision to increase reservations for the BCs was a result of a unanimous resolution passed by the state assembly."Such unanimity is rarely seen in today's politics. But in the HC, we were heard without pleadings, and orders were passed, which has caused significant grievance to the state," he said and sought urgent consideration of the matter.Meanwhile, the counsels appearing for the petitioners before the HC informed the Apex court how the decision to increase reservations violated the Supreme Court's laid-down triple test formula.They also contended that the SC, ST, and BCs are different from Politically Backward Classes (PBCs) and the state does not have a list of such PBCs. "So, whoever they are going to give this reservation to, they don't exist," they argued.
