'Truly alarming': Bombay high court orders removal of deepfake content infringing Akshay Kumar's personality rights | Mumbai News - The Times of India

Mumbai: Offering a reprieve to actor Akshay Kumar against unknown persons and some e-commerce sites for infringing his personality rights, the Bombay High Court directed the immediate removal of certain 'deepfake' content online. The HC said its immediate interim intervention was necessary and "such content needs to be removed from the public domain immediately, not only in the interest of the actor but also in the larger public interest".Justice Arif Doctor, whose order was made available on Thursday, said he perused the suit filed by the actor and noted that what was "truly alarming in a number of these cases is the realistic nature of deepfake images/videos that are being created by using AI"."Both in the context of images and videos, the morphing is so sophisticated and deceptive that it is virtually impossible to discern that the same are not genuine images/videos of the Plaintiff (Akshay). The deepfake video of the Plaintiff making communally inflammatory statements and statements about Rishi Valmiki is deeply concerning. The consequences that can arise from such content being disseminated are indeed most grave and serious. Apart from violating and affecting the Plaintiff's personality and moral rights, such videos also pose a grave threat to the safety and well-being of the Plaintiff's family members and can also have an adverse and widespread impact on society and public order, which clearly appears to be the agenda of those who create such content," Justice Doctor observed in his order after hearing senior counsel Birendra Saraf for the actor.The HC said additionally the material on record discloses the egregious nature of the infringing material, particularly the creation and dissemination of AI-generated morphed photos/deepfakes depicting the actor, the unauthorised offering of services (including through AI) infringing upon his persona, unauthorised sale of merchandise, and using AI-generated images. Since he is a public persona, there is little doubt that his personality, including his name, screen name, signature, image, likeness, voice and tone, and distinctive performance appearance, have become uniquely identifiable for the public. Hence, given the irreversible harm potential, the unidentified persons styled as John Doe and certain sites are restrained from violating his rights.
