Hyderabad: The Telangana high court directed the chief secretary to "reprimand the district collector" of Sircilla district, Sandeep Kumar Jha, for initiating criminal proceedings against a woman despite a clear court order in her favour. The court termed the criminal case a blatant violation of constitutional rights and an "abuse of process of law".In a strongly worded order pronounced on Thursday, Justice Anil Kumar Jukanti criticised Jha, stating, "Initially, this court was inclined to take firm action, but it restrains itself, keeping in view the long tenure of the officer. The chief secretary is directed to reprimand the officer."The court's action against Jha followed a criminal case registered against a woman from the district on the instructions of the collector for allegedly misleading the court to obtain compensation for losing her land to the Manair project. The court also quashed the criminal case against the woman.The judge further observed that the collector "on his own volition, without jurisdiction, set the criminal law into motion" even though the court earlier held the petitioner eligible for rehabilitation benefits as a project-displaced family. Such actions were "grave, wilful in nature, and cannot be condoned," the judge said.The judge also noted that instead of complying with its 2023 order granting the woman benefits, the collector and his subordinates instigated the tahsildar to file a complaint, branding her as having "misguided the court". The HC held that this amounted to a direct assault on the petitioner's right to life and liberty under Article 21 of the Constitution."The district collector, the executive head of the district, not only displayed disregard for the rule of law, but tried to circumvent the orders of this court by directing officers to initiate civil and criminal proceedings," the judge remarked, adding that such "acts perpetrated shocks the conscience of this court, nothing more is to be penned."Quoting that "to err is human, to forgive is divine," the counsel informed the judge that the benefits are being provided and the case is also withdrawn. Stating that the acts show the office of the collector "in poor light", the court noted that it has to be determined if those acts by the head of the district administration are mere errors committed inadvertently or in disregard to the rule of law, from facts and circumstances of the case.
