New Delhi, Sep 15: The Supreme Court on Monday observed that if any illegality is detected in the methodology adopted by the Election Commission of India (ECI) during the Special Intensive Revision (SIR) of electoral rolls in Bihar, the entire exercise will stand invalidated. Importantly, the ruling will extend beyond Bihar, with the court clarifying that its verdict will have pan-India implications, as reported by The Times of India and national media. A bench of Justices Surya Kant and Joymalya Bagchi scheduled October 7 for the final hearing on petitions challenging the validity of the Bihar SIR. "Our judgment in Bihar SIR will be applicable for Pan-India SIR. We cannot give a piecemeal opinion on Bihar alone," the bench remarked. While presuming that the ECI was acting within the ambit of law, the bench underlined that the exercise would be struck down if it was found to have compromised constitutional safeguards. The court also allowed petitioners to argue not only on Bihar-specific concerns but also on the legality of the nationwide SIR process. At the same time, the bench issued notice on a plea seeking recall of its September 8 order, which had directed the poll panel to include Aadhaar as the 12th prescribed document for the Bihar SIR. On that day, the apex court had clarified that while Aadhaar is not proof of citizenship, the ECI could verify its genuineness when submitted for voter roll inclusion. During the proceedings senior advocate Gopal S argued, "If prima facie perversion of the constitutional scheme is found, we would then be entitled to press that the process should not continue... Let ECI also be heard on law. As of now, 7.89 crore voters, as per them, were there initially; 4.96 crore were automatically included in the draft roll... There's an estimate of 6.84 crores of those with Aadhaar." Responding to the submissions, Justice Kant said, "It can be assumed that those who are being excluded are being excluded for absence of documents only." The outcome of the October 7 hearing is expected to shape not only the fate of the Bihar exercise but also the broader framework of electoral roll revisions across the country.
