Kupwara, Sep 13: People's Democratic Party (PDP) president, Mehbooba Mufti on Friday strongly criticised the detention of Aam Aadmi Party (AAP) MLA Mehraj Malik under the Public Safety Act (PSA), calling it an attack on democratic institutions. She urged the Jammu & Kashmir Legislative Assembly to convene an urgent session over the issue. Speaking to reporters in Kupwara, Mehbooba said she has been restless ever since Malik was jailed. "Instead of offering personal legal aid, the Chief Minister and the Speaker should have taken institutional steps," she said. If Mehraj Malik needs a lawyer, he will go to one, not to the Chief Minister, Mehbooba said, adding that the Speaker should have taken cognisance of the incident and called an urgent Assembly session. "There should have been a debate, and a resolution should have been passed to Delhi that this will not be tolerated," she added. The PDP chief said such a move would have pressured the Centre to reconsider its action. "If a resolution had gone to the Home Minister, there would have been pressure for Malik's release, and the central government would have thought a hundred times before invoking PSA against any sitting MLA in future," she said. Mufti said that Malik, as an MLA, has the resources to hire legal counsel on his own. "There are thousands of prisoners whose families do not even have the means to visit them in Tihar, Rajasthan, UP, or Agra jails. If Omar Abdullah wants to help someone legally, it should be them. Malik is an honourable MLA, he has money, he can afford his own lawyer," she said. The former Chief Minister said MLA Malik's father had already expressed regret and apology, and his meeting with the Chief Minister was not for legal help. "He went with a message that with 50 MLAs and three MPs, you must call a session and put pressure on the Government of India. But instead, those who raised this issue were issued notices, which is unfair," she claimed. Appealing to the Speaker, she said, "Settle political scores with PDP if you want, but also call a session. Have a discussion, pass a resolution, and ensure that this kind of action does not happen again with any MLA." Mehbooba urged collective political action to secure Malik's release and to "safeguard the dignity" of elected representatives in Jammu and Kashmir.
