New Delhi/Mumbai: Supreme Court on Monday rebuffed fresh attempts to mire the Rs 229-crore passenger water terminal (PWT) project abutting the Gateway of India in Colaba as Maharashtra govt said the project has green nod from every relevant authority and would help reduce travel time between Colaba and Navi Mumbai, Mandvi and Alibaug.After hearing elaborate arguments on behalf of Clean and Heritage Colaba Residents Association and other residents, a bench of CJI Bhushan R Gavai and K Vinod Chandran refused to interfere with Bombay high court's judgment validating the state govt's decision to construct the passenger jetty and terminal facilities near Radio Club in Apollo Bunder.The appellant association argued that such huge construction over the sea to set up a large permanent jetty is being undertaken without proper green clearance from the State Environment Impact Assessment Authority or the central govt. It also complained the jetty would enable 20 boats to ferry passengers at a given time, which would cause severe congestion.For Maharashtra, solicitor general Tushar Mehta told the court that the petitioners were erroneously equating the jetty with ports, which would require huge infrastructure for handling cargo.The HC had followed the CJI-propounded sustainable development theory and said, "The pursuit of development is not an affront to the environment when it walks the careful path of sustainability guarded by regulations and reasons". After perusing the records, the HC had validated the decision of the Maharashtra Maritime Board and the state govt to construct the PWT project.When the petitioners objected to the jetty on the ground of its proximity to the heritage structure - the Gateway of India - and expressed apprehension that such huge construction would dominate the sea front and spoil the heritage area, Mehta said the association is adopting the "not in my backyard" approach towards the project, which would provide effective waterway transport for people and reduce the travel time between Colaba, Navi Mumbai, Mandvi and Alibaug by one-third the present duration of travel.CJI Gavai recalled that an earlier petitioner had cited 'Amchi Mumbai' to oppose the project and the SC had dismissed that plea. He said, "Amchi Mumbai does not live in the sea-facing buildings of Colaba. It lives in Girgaum, Dombivli, Borivli and similar locations spread across Mumbai."The SC decision is a green signal for the jetty project, said ports minister Nitesh Rane. "Thanks to this ambitious project of the Mahayuti govt, Mumbaikars will get relief from traffic congestion and get to experience modern, safe, and speedy facilities for sea travel," he said. "The terminal will include a waiting lounge, ticket counters, administrative offices, as well as parking facilities. The existing jetty will be gradually decommissioned."
