Minor loses arm in bonded labour abuse, rights panel steps in | Chandigarh News - Times of India

Jind: Following a report published in TOI on Aug 7, highlighting the harrowing case of a 15-year-old boy allegedly held as a bonded labourer and subjected to brutal abuse for two months, the Haryana Human Rights Commission has taken suo motu cognizance and issued strict directives to authorities in Jind and Nuh districts.The full commission, comprising chairperson Justice Lalit Batra and members Kuldip Jain and Deep Bhatia, expressed grave concern over the incident, describing it as a disturbing reflection of the breakdown of protective mechanisms meant to safeguard children. The commission noted that the boy endured physical harm, deprivation of food, water, and medical care, and was ultimately rescued by a compassionate teacher -- an act that underscored both the child's helplessness and his extraordinary resilience.Justice Lalit Batra emphasised that the treatment meted out to the minor was a clear violation of international legal obligations, particularly Article 32 of the United Nations Convention on the Rights of the Child, which protects children from economic exploitation and hazardous work. The incident also prima facie violates several domestic laws, including the Bonded Labour System (Abolition) Act, 1976, and the Child and Adolescent Labour (Prohibition and Regulation) Act, 1986.The commission also observed that, if proven true, the allegations amount to a gross violation of fundamental rights under Articles 21 and 23 of the Indian Constitution, which guarantee the right to live with dignity and prohibit human trafficking and forced labour. The failure to detect and prevent such exploitation in time raises serious concerns about the effectiveness of monitoring and rescue mechanisms, especially in vulnerable migration corridors.Given the gravity of the case and the victim's vulnerable condition, the commission unanimously held that the matter requires urgent and comprehensive investigation. It called for accountability of those responsible and directed that the child be provided with appropriate medical, psychological, and rehabilitation support.Commission spokesperson Puneet Arora outlined the key directives issued by the panel, which include the identification and arrest of the accused, verification of bonded labour practices at the dairy establishment, submission of a detailed medical report of the injured child, and preparation of a rehabilitation plan. A thorough inquiry into possible violations of labour laws has also been ordered. The next hearing in the matter is scheduled for Nov 4.The boy, a resident of Kishanganj district in Bihar, was reportedly lured into bonded labour under the false promise of employment. After getting separated from his companions at Bahadurgarh Railway Station, he came into contact with an unknown person who offered him work at a buffalo dairy in Jind, with a promised salary of Rs 10,000 per month. Instead, he was subjected to forced labour and physical abuse for two months. The situation worsened when he suffered a severe injury while cutting fodder, resulting in the amputation of his hand up to the elbow. The employer then abandoned him at an isolated location without assistance.Despite his injuries, the boy managed to reach Nuh, where a teacher found him, provided medical help at a local health centre, and alerted the police. He was later taken to PGIMS Rohtak, where doctors performed surgery on his injured hand.Speaking to TOI, Jind superintendent of police Kuldeep Singh confirmed that a thorough investigation is under way. Police have recorded the boy's statement during his treatment at PGIMS and shared the report with authorities in Jhajjar, Rohtak, Nuh, and the railway police. Singh added that the boy was held captive in a forest-surrounded location, and the matter is being investigated in detail.
