New Delhi: Noting that the issue of Sainik Farms regularisation is "hanging fire for years", Delhi High Court on Wednesday said residents had not been able to "lay a brick for repairs".It questioned the failure of the central and Delhi govts to bring "a simple legislation to mitigate the problem" of residents awaiting regularisation of the posh south Delhi colony."Why can't you take up the issue a bit seriously? Now there should be no difficulty in the Centre and Delhi govt sitting together and taking a decision. You have to find a solution by way of legislation; that's the only way this situation can be resolved. Residents are already in Sainik Farms for decades now," a bench of Chief Justice DK Upadhyaya and Justice Tushar Rao Gedela told standing counsel Sameer Vashisht.The court pointed out that it earlier requested additional solicitor general Chetan Sharma to assist it in the matter but was informed that the Centre's law officer had to leave urgently. The bench lamented that the authorities were not taking any final decision on the issue and just "passing the buck", which ultimately "stops at the court", and it is expected to pass orders on an issue which govt should decide."The basic question remains as to what the central govt, in consultation with the state govt, is doing for regularising these colonies. You have to make a final decision. It appears again that everybody is trying to pass the buck, as happens in these matters," it remarked."First and last thing we want to know is what is it that you are doing about these colonies? We can't be clearer than this. You know very well why they are existing, how they are existing till now. None of the govt will do anything to mitigate the problems." The court said the residents had been there for decades now and were not going to go anywhere. "Think about a possible solution because, within the current statutory framework, perhaps nothing is possible," it added.When Delhi govt's counsel said the 2019 notification of the Centre barred it from entering into the issues of affluent colonies, the bench said the Delhi administration would have to get its voice heard before the relevant authorities if it said it couldn't do something needed for the residents."We are only concerned because the residents have been residing there since the 1950s and the constructions are all illegal, but if you undertake a demolition to such a large extent, then we can't do anything except to dismiss the petitions," it added, posting the matter for Oct 8. The high court said it expected a decision on the matter from the authorities by the next date.
