Chennai, Aug 1 (UNI) Dravidian naming spree of state-funded schemes after ideological icons and current as well as former Chief Ministers has met with judicial ire with Madras High Court on Friday restraining the Tamil Nadu Government from using the names of any living personality in the nomenclature of new or re-branded government welfare programmes. The First Bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan, in an interim order, also prohibited the display of portraits, pictures of former Chief Ministers or ideological icons as well as insignia/emblem/flag of the ruling DMK in the publicity materials for those government schemes. "We are inclined to pass an interim order to the effect that while launching and operating government welfare schemes through various advertisements, the name of any living personality, photograph of any former Chief Minister/ ideological leaders or party insignia/emblem/flag shall not be included," the Bench said in its order. Meanwhile, the State government has decided to file an appeal against the order. The interim order was passed on a PIL petition filed by former AIADMK Minister, CV Shanmugham, MP, against the use of Chief Minister MK Stalin's name in the ongoing massive public outreach programme 'Ungaludan Stalin' (Stalin with You), launched to take government services to the doorsteps of the people through state-wide special camps. However, the court made it clear that no order has been passed against the launch, implementation, or operation of any welfare scheme and the present interim order is confined only to the nomenclature of the schemes and the publicity materials for the same. It was also pointed out that the interim order was passed on the basis of prima facie materials. Further, the court observed that the Supreme Court had, in the State of Karnataka Vs Common Cause and others, made it clear that publication of the photograph of incumbent Chief Minister was permissible but use of photographs of ideological leaders or former Chief Ministers was prima facie violative of the apex court's directives. Also, it is impermissible to have the names of political personalities in the nomenclature of a government scheme, it pointed out adding that the use of the name of the ruling party was also against the apex court's ruling and that of the Election Commission. The Bench ordered notices to the state government and the DMK on the main petition against the nomenclature 'Ungaludan Stalin' programme. Next hearing in the case has been posted to August 13.
