Mumbai: The Bombay High Court on Thursday dismissed a challenge to the provisions of the anti-terror law -- Unlawful Activities (Prevention) Act (UAPA). The UAPA in its present form is constitutionally valid; therefore, the challenge to its vires fails, and the petition is dismissed, said a division bench of Justices Ajay Gadkari and Neela Gokhale. The High Court had earlier sought responses from the state and central govts to a petition by one Anil Baile challenging the constitutional validity of the UAPA, 1967, and Section 124A (sedition) of the Indian Penal Code (IPC). Baile was issued a notice in 2020 in connection with the Elgaar Parishad case. His petition claimed that the UAPA granted "unbridled power" to the executive to declare an organisation or an individual and their activity as unlawful without defining the same in the law.His contention was that an amendment to the UAPA to adopt the United Nations Security Council's 2001 resolution, which was for criminalising any person supporting international terrorism, made it possible for the govt to declare an Indian citizen or an organisation as a terrorist. He also sought the setting aside of the July 10, 2020, notice issued to the petitioner by the National Investigation Agency (NIA).The NIA opposed his petition, saying no case was made out to hold the Act, which came into force on 30 December 1967, or its provisions unconstitutional, nor the provision challenged under IPC. The Centre argued that there was "no provision in the Constitution of India that only by virtue of amendment of the Constitution" a law already framed becomes unconstitutional. "There are checks and balances in the UAPA. The right to default bail is available. The accused needs to be produced before a special court within the time stipulated under Section 43 of UAPA," the NIA special counsel said.The petitioner said the question that needs to be decided was whether in a democratic nation, the concepts laid down in UAPA and the sedition concept under erstwhile Section 124A of the IPC have any place in law. The reasoned High Court judgment will be made available in due course.
