New Delhi: The Supreme Court on Thursday pressed the Election Commission of India (ECI) to justify the timing of its Special Intensive Revision (SIR) of electoral rolls in poll-bound Bihar, observing that the exercise "went to the root of democracy and power to vote". "If you are to check citizenship under SIR of electoral rolls in Bihar, then you should have acted early; it is a bit late," Justice Sudhanshu Dhulia remarked while sitting with Justice Joymalya Bagchi. Appearing for the poll body, senior advocate Rakesh Dwivedi argued -- citing Article 326 of the Constitution -- that "every voter has to be an Indian citizen and Aadhaar card is not proof of citizenship". He maintained that an intensive revision was last carried out in 2003 and that the ECI alone was empowered to update the rolls to include or exclude names as required. More than ten petitions, led by NGO Association for Democratic Reforms and joined by Opposition MPs including Manoj Jha (RJD), Mahua Moitra (Trinamool Congress) and K C Venugopal (Congress), have challenged the EC's 8 May notification ordering the fresh revision. Justice Dhulia crystal-ised the court's preliminary view in three parts: "We are prima facie of the opinion that there are three questions: 1. Powers of ECI to conduct, 2. The procedure to exercise the powers and 3. The timeline which is very short and due in November and notification will come in advance." The bench rejected the petitioners' contention that the Commission lacked authority to initiate the drive, but said the questions merited detailed hearing. "The matter needs hearing. Let it be listed on July 28 before appropriate court. Let counter be filed within one week, on or before July 21 and rejoinder before July 28," the court directed. It further recorded the EC's submission that eleven documents are accepted for voter verification and advised the inclusion of popular proofs: "After going through the documents, ECI has pointed out that the list of documents for verification of voters include 11 and is not exhaustive. Thus IN OUR OPINION IT WOULD BE INTEREST OF JUSTICE IF AADHAAR CARD, EPIC Card and RATION CARD should be included ... (clarifies that it is for the ECI to still decide whether it wants to take the documents or not and if it does not take the documents then give reasons for the same) and the same shall satisfy the petitioners." The petitioners, the bench noted, "are not pressing for an interim stay" on the revision exercise. Dwivedi stressed that the Commission "will not leave out anyone from the voter list without an opportunity to be heard", adding that the SIR targets roughly 7.9 crore electors across Bihar. The hearing will resume on 28 July, when the top court is expected to test the legality and practicality of conducting a statewide revision barely months before assembly elections.
