Kolkata: School Service Commission and Bengal govt on Tuesday moved a Calcutta High Court division bench, challenging a single judge's order to not allow candidates deemed "tainted" to participate in the fresh recruitment process for 35,726 vacancies. Other candidates have moved the division bench on two demands -- marks allotment and age relaxation.The bench of Justice Saugata Bhattacharyya on Monday refused to allow "tainted candidates" to take part, referring to Supreme Court's observation stating that their appointments were the "result of fraud which amounts to cheating". The judge directed that if any tainted candidate submitted an application pursuant to the recruitment notification of May 30, 2025, it would stand cancelled.The judge did not interfere with fixing of minimum marks at 50% instead of 45% observing it to be a policy decision of the recruiting authority. The petitioners also challenged the clubbing of the 2016 recruitment with the 2025 recruitment. The court did not interfere with this either, following which they moved the division bench.The matters will be heard together before the bench of justices Soumen Sen and Smita Das De on Wednesday.
