The Supreme Court on Tuesday (December 3, 2024) directed the Jacobite Syrian group to hand over the administration of six churches in Ernakulam and Palakkad districts of Kerala to the Malankara Orthodox Syrian faction in compliance with apex court judgments and the 1934 constitution of the church. A Bench of Justices Surya Kant and Ujjal Bhuyyan however asked the Orthodox group to give an undertaking that public facilities in these parish churches, including burial grounds, schools and hospitals, would be open to all members of the community. The apex court listed the case after two weeks while voicing hope that both groups would celebrate Christmas in peace and harmony. The Bench was hearing special leave petitions filed by Kerala government officials, the State Police and also members of the Jacobite group against a direction of the Kerala High Court to the district administrations to take possession of the six churches. The top court said the Jacobite group was undoubtedly in contempt for having willfully disobeyed two judgments of the Supreme Court, in 2017 and 2020, which had directed the Jacobite faction to hand over the administration of the Malankara's numerous parish churches to the Orthodox group in accordance with the 1934 constitution. Patriarch Mor Ignatius Aphrem II calls for peace between warring Jacobite, Orthodox factions "Consequently, we direct the petitioners (Jacobite section) to hand over the administration (only) and submit a compliance affidavit, failing which necessary consequences shall follow," the apex court ordered. Justice Kant told senior advocate Shyam Divan, for the Jacobite faction, that for the court to hear them, his clients would have to first hand over the administration. This would not cause any prejudice to their legal rights before the court. "We want you to comply with our judgments first," Justice Kant addressed Mr. Divan. State intervention The court frowned upon the State intervening in the dispute over the management of religious affairs of two groups. "Intervention by the State is only the last resort. If the State intervenes, then it should be given a free hand and take over everything... We will direct the State to take over completely your financial and other affairs. To go into your accounts - from where your money is coming from, etc... There is no question of the State standing by as a silent spectator," Justice Kant told both warring groups. The schism within the Malankara church had impacted over 2000 parish churches and 30 million followers across the world. The 2017 judgment had found the 1934 constitution was "appropriate and adequate" for the management of the Malankara parish churches. In fact, the 2017 verdict reiterated decisions of the Supreme Court in 1958 and 1995 that the 1934 constitution of the Malankara church governed the parish churches under it. The dispute between the group with allegiance to the Patriarch of Antioch in Syria (Jacobite faction) and the Catholicos of the East dates back over a century.
