Cuttack: Orissa high court has granted a 10-day interim bail to Chintan Raghuvanshi, a 2013-batch Indian Revenue Service (IRS) officer and deputy director of the enforcement directorate (ED), Bhubaneswar, who was arrested by the CBI in a bribery case on May 30.Justice Gourishankar Satapathy passed the order on July 2 after hearing an interlocutory application filed by Raghuvanshi, who sought interim bail to visit his newborn child. He had earlier moved the court citing the pregnancy of his wife, but by the time the matter came up for hearing, his wife had delivered the baby on June 28.The HC scheduled the hearing of regular bail application for July 15. Raghuvanshi has been in custody since his arrest.During the hearing, CBI counsel Sarthak Nayak opposed the plea, arguing that releasing the officer at this stage could allow him to interfere in the investigation. However, the court noted that the petitioner had been in custody for over a month and that the investigation must have progressed substantially."Interim bail is not defined in statute but evolved through judicial decisions," Justice Satapathy observed. "It is granted on special contingencies, and the facts of this case are considered peculiar and exceptional. The petitioner is not a hardened criminal, nor is there any material suggesting he will abscond," he said.Granting the interim relief on humanitarian grounds, the court said the desire of a father to see his newborn cannot be ignored. "Balancing the emotion of a father and the facts of the case, the petitioner is admitted to interim bail for 10 days from the date of his actual release," the court said.The court also permitted the lower court to impose suitable conditions during the interim bail period. It directed Raghuvanshi to surrender immediately after the expiry of bail and warned of coercive action if he failed to do so.
