New Delhi, Dec 16: Members of Parliament from Jammu and Kashmir National Conference on Monday submitted a detailed memorandum to Union Home Minister Amit Shah, raising humanitarian, constitutional, and governance concerns linked to the Union Territory. The memorandum was submitted by Rajya Sabha MPs Choudhary Mohammad Ramzan, Sajad Ahmad Kitchloo, and Gurninder Singh Oberoi. It focuses on three key issues: prisoners lodged outside Jammu and Kashmir, restoration of full statehood, and notification of Business Rules for the elected government. The MPs highlighted the hardship faced by families whose relatives from Jammu and Kashmir are lodged in jails outside the Union Territory. They said thousands of families struggle to meet with detainees due to distance, cost, and legal barriers. "Mothers, children, and elderly parents suffer the most. In many cases, detainees remain incarcerated despite charges not being proven," they said. The memorandum urged the Centre to review the policy of lodging prisoners outside Jammu and Kashmir. It also sought the release of those against whom no serious charges are established. The MPs stressed that prolonged detention away from home punishes innocent families and violates basic humanitarian principles. On statehood, the MPs recalled assurances given by the Prime Minister and the Union Government that full statehood would be restored. They also cited the Supreme Court judgment of December 11, 2023, which recorded the Centre's commitment to restore statehood at the earliest after democratic processes, including elections, were completed. They said elections have been successfully held and an elected government is now in place. "The continued delay in restoring statehood, they argued, is causing democratic and administrative distress and is being seen as a denial of constitutional dignity by the people," the MPs said The memorandum further raised concern over the non-notification of Business Rules in Jammu and Kashmir. The MPs said this has created ambiguity in governance, weakened the authority of elected representatives, and affected accountability. They demanded immediate notification of Business Rules to ensure smooth and transparent administration. The MPs urged the Union Home Minister to take clear, concrete, and time-bound steps on all three issues. "Restoring statehood, addressing humanitarian concerns, and strengthening democratic governance are essential to rebuild trust and normalcy in Jammu and Kashmir," they said.
