New Delhi: Ahead of local body elections in state, Shiv Sena (UBT), which is fighting a legal battle with Eknath Shinde for the party's name and symbol, sought an early hearing in SC and urged the court Wednesday to make the same arrangement as was done in the NCP factional dispute.Senior advocate Devadatt Kamat said that notification for the elections may come next week and pleaded that the SC should hear the case filed against the EC's decision to recognise Shinde faction as the real Sena. He said a similar order, as in the NCP case, be passed. In that case, SC had allowed Ajit Pawar to use NCP's 'clock' symbol with the caveat that he must mention in all print and audio/visual advertisements that litigation over the name and symbol of the undivided party is sub-judice. It also barred the deputy CM from using Sharad Pawar's name and picture. Repling to the Shiv Sena (UBT)'s demand for an early Supreme Court hearing in its legal battle over the party's name and symbol, the Eknath Shinde-led Shiv Sena opposed early listing of the case, and its lawyer told the bench of Justices M M Sundresh and K Vinod Chandran that the case was pending for the last two years, during which parliamentary and assembly elections had taken place.He said that the UBT faction had made the same plea in May after the Supreme Court directed the state election commission to notify elections for local bodies, but it was not allowed.After a brief hearing, the bench said that there was no urgency in the case, and the court could pass an order even after notification for the polls was issued by the Election Commission. It, however, posted the case on the reopening day of SC after summer vacation on July 14.The elections to local bodies - there are 409 urban local bodies and over 28,000 rural local bodies - are to be held as per the order of the SC. Elections had not been held in many of these local bodies for years because of the SC's status quo order in Aug 2022.Setting a timeline for the elections, the apex court had said that it was unthinkable that in India, where grassroots democracy is given importance both in society and in the Constitution, there were local bodies without representatives of people and manned by bureaucrats without any accountability.
